Electronic Records and Signatures Consent

This Electronic Records and Signatures Consent (the “Consent”) explains how AiroDental LLC (“AiroDental,” “we”) presents records and captures signatures electronically, and the rights you have when you sign electronically. It applies whenever you sign, accept, or acknowledge a document in an AiroDental product, including a treatment plan, a payment authorization, a consent form, or another agreement. We provide this Consent under the federal Electronic Signatures in Global and National Commerce Act (“ESIGN Act,” 15 U.S.C. § 7001) and the Uniform Electronic Transactions Act (“UETA”) as adopted in your state.

1. Your consent to do business electronically

When you choose to sign or accept a record electronically, you agree that we may provide that record, and related disclosures and notices, to you in electronic form, and that your electronic signature has the same legal effect as a handwritten signature on paper. Your consent applies to the specific record you are signing and to the disclosures and notices that go with it. It does not commit you to sign anything else electronically.

2. Your right to a paper copy

You may ask for a paper copy of any record we provide to you electronically. We do not charge a fee for a paper copy. To request one, contact the dental practice that sent you the record, or contact us at [email protected]. Asking for a paper copy does not, by itself, withdraw your consent to do business electronically.

3. Your right to withdraw consent

You may withdraw your consent to do business electronically at any time. To withdraw consent, contact the dental practice that sent you the record, or contact us at [email protected]. Withdrawing consent applies going forward and does not affect the validity of any record you already signed electronically. If you withdraw consent, you may not be able to complete a task that is offered only electronically, and the practice may ask you to sign on paper instead. There is no fee to withdraw consent.

4. Keeping your contact information current

We deliver electronic records to you through the same channel that brought you the link, such as a text message or an email, or on screen while you are signing. Tell the dental practice if your mobile number or email address changes, so that records reach you.

5. What you need to view and keep records

To view, sign, and keep electronic records, you need a device with a current web browser, a connection to the internet, and either an email account or a mobile number that can receive text messages. To keep a copy, you need a way to print the record or to save a PDF file. If our requirements to access records change in a way that could stop you from viewing records you have a right to keep, we will tell you and give you the chance to withdraw consent without a fee.

6. How you sign

You sign by drawing your signature, typing your name, checking a box that says you agree, or clicking a button that says you accept, as shown on screen. Taking that action is your electronic signature. It shows that you intend to sign the record and to be bound by it. No third-party certificate or verification is needed for your signature to be valid.

7. The record we keep

When you sign, we record the document you signed, the version of that document, the date and time, and technical details that help show the signature is yours, such as the network address of the device you used. We keep the signed record so that it accurately reflects what you signed and can be reproduced for you and for the dental practice. Where a record is part of your dental chart, the practice keeps it for the period required by the laws of your state. We describe how we handle your information in the Privacy Policy and, for payments, the AiroDental Pay Privacy Policy.

8. Signing on behalf of another person

If you sign as a parent, guardian, or authorized representative of the patient, you confirm that you have the authority to sign for that person, and your electronic signature binds that person to the record to the extent the law allows.
